How Do Courts Review Child Support Disputes?

The courts consider many factors when reviewing child support disputes including but not limited to:

  • The type of relationships the claimants have with the child(ren) including length, nature and history involved with the relationships
  • How the relationships may impact the child(ren)
  • What is in the best interest of the child(ren)
  • Applicable legislation and case law

  • Are never based on gender. Equal responsibility rests on both parents depending on the income each spouse earns and who the primary caregiver for the child is
  • Child support payments can be varied with court orders
  • Child support may be retroactively enforced
