How to File for Divorce in Alberta

There are two possible courts to receive a ruling when filing for divorce in Alberta. There is the main Court of Queen’s Bench and there is also the Provincial Court’s Family Division. The subsequent steps of filing for divorce in Alberta are as follows:

Filing the Statement of Claim

This is a document which includes the date of marriage, birthdates of both spouses and any children along with terms for child support, custody and the terms of spousal support.

Serving the Statement of Claim & Answering

If you filed the Statement of Claim, then you become the plaintiff and your spouse will be served the claim and become the defendant. The statement must be served to your spouse in-person by another adult that is not you and your spouse will have 20 days to answer.

Contested vs. Uncontested

If your spouse answers by contesting, we then move forward to negotiations. Here, both parties will have to disclose all financial information so that they can accurately dispute custody and support issues.
